5. Limitation of Liability

Harbor is a self-help and well-being tool designed to support everyday stress management, worry, low mood, and the practice of coping techniques. It is not a substitute for professional medical, psychological, psychiatric, or other healthcare advice, diagnosis, or treatment.

Harbor does not provide medical or mental health care, and use of the app does not create a doctor-patient, therapist-client, or other healthcare professional relationship between you and Harbor.

The information, exercises, suggestions, and other content provided through Harbor are intended for general educational and self-help purposes. While we aim to base our content on established approaches, including techniques informed by published CBT and mindfulness research, we do not guarantee that any particular exercise, recommendation, or feature will be suitable or effective for you or your individual circumstances.

You are responsible for deciding whether and how to use the content provided through Harbor. If you have concerns about your physical or mental health, you should seek advice from an appropriately qualified healthcare professional.

Harbor is not intended for use in emergencies or situations requiring immediate professional intervention. If you believe that you or someone else is in immediate danger, or you are experiencing a mental health crisis, contact the appropriate emergency services or crisis support service in your country.

To the maximum extent permitted by applicable law, Harbor and its owners, operators, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, or unforeseeable loss or damage arising from or related to your use of, or inability to use, Harbor, including reliance on information or exercises made available through the app.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable law. In particular, nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under applicable law.

To the extent permitted by applicable law, if Harbor is found liable for any loss arising from your use of the service, our liability will be limited to the amount you paid to use Harbor during the twelve months preceding the event giving rise to the claim. This limitation does not apply to liabilities that cannot legally be limited.

Because Harbor may depend on third-party infrastructure, internet connectivity, and other services, we do not guarantee that the app will always be available, uninterrupted, secure, or error-free. We will take reasonable steps to maintain and improve the service, but temporary interruptions may occur.

The limitations in this section apply only to the extent permitted by the mandatory laws applicable to you. If the laws of your country provide you with rights or remedies that cannot be excluded or limited by contract, those rights and remedies remain unaffected.
